If you cannot distribute so as to satisfy simultaneously your obligations under this License and any other pertinent obligations, then as a consequence you may not distribute the Program at all.

That include both the guy who signs the NDA and the guy who wrote the NDA in the first place — each of them are unable to properly satisfy the requirements of the GPL so they might be up for Copyright infringement (potentially nasty).
